General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all contracts, deliveries, and services between Ben Ferster, represented by Ben Ferster, and the customer, in the version valid at the time of contract conclusion.

2. Contracting Party

3. Conclusion of Contract

The offers in our shop are non-binding. By placing an order, the customer makes a binding offer to enter into a contract. The contract is concluded upon written confirmation or delivery of the goods.

4. Prices and Payment

All prices are final prices. Due to the small business status according to § 19 of the German VAT Act (UStG), no VAT is charged.
Payment is made via PayPal.

5. Delivery

Delivery takes place within 1–3 working days after receipt of payment, unless otherwise stated.
Shipping costs are charged additionally and are clearly communicated before the contract is concluded.

6. Retention of Title

The goods remain the property of the seller until full payment has been received.

7. Warranty

Statutory warranty rights apply.
In the case of defects, the customer may initially request rectification or replacement.

8. Liability

The seller is only liable for damages caused by gross negligence or intent.
For simple negligence, the seller is only liable for the breach of essential contractual obligations.

9. Data Protection

Personal data is used exclusively for contract processing and is not passed on to third parties, except for delivery processing by DHL.

10. Final Provisions

The law of the Federal Republic of Germany applies.
Should any provision of these GTC be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
